1. About these terms

These Terms of Service govern the use of Nala Try-On ("Nala", "we", "our", or "the app"), a Shopify application operated by Nala Commerce. By installing or using the app, the merchant agrees to these terms.

The merchant's agreement with Shopify governs the Shopify platform itself; these terms cover Nala Try-On.

2. The service

Nala Try-On provides camera-based virtual try-on and interactive 3D product experiences on Shopify storefronts. Product images, 3D models, and app-owned product configuration are associated with the merchant's Shopify store.

We may improve, add, change, or remove features as the app develops.

3. Merchant responsibilities

The merchant is responsible for having the rights to product images, 3D models and other content used with the app; for the accuracy of product information; for the security of their Shopify account; and for complying with laws that apply to their store, including consumer, advertising and privacy requirements.

4. Acceptable use

The app may not be used to break the law or infringe third-party rights, upload content the merchant has no right to use, attempt unauthorized access, interfere with the service, or resell/redistribute the app without written permission.

5. Camera use

Camera-based try-on starts only when the shopper chooses to use it and grants camera permission. Camera frames are processed locally in the shopper's browser as described in our Privacy Policy. The merchant remains responsible for any additional notices or consent required in the markets where the store operates.

6. Pricing and billing

Plans, prices, limits, billing periods, and any free trial are shown in Shopify at the point of installation or plan selection. Nala Try-On uses Shopify billing/managed pricing where applicable.

Charges, plan changes, cancellation, credits, and refunds are processed according to Shopify's applicable billing terms, the merchant's agreement with Shopify, and mandatory law. Uninstalling the app stops future app access and prevents future billing from Nala after Shopify processes the cancellation.

7. Intellectual property

The app, its interface, and its underlying software remain the property of Nala Commerce. Merchant content remains the merchant's property. The merchant grants only the limited permission needed to process and display that content to operate the app.

8. Third-party services

The app depends on Shopify and third-party infrastructure, including Cloudflare and browser-delivered libraries/models used for 3D rendering and face tracking. Those services operate under their own terms and may affect availability.

9. Availability and support

We aim to keep the app available and working but do not guarantee uninterrupted service. Maintenance, Shopify changes, browser changes, network conditions, and third-party outages may affect availability. Support is available at hello@nalacommerce.com and on the Support page.

10. Try-On accuracy

Virtual Try-On and 3D views are visualization aids. Appearance and alignment can vary with camera quality, lighting, device capability, source assets, and configuration. They do not guarantee physical fit and must not be presented as medical, prescription, or exact biometric measurements.

11. Limitation of liability

To the extent permitted by law, Nala Commerce is not liable for indirect or consequential loss, lost profits, lost sales, or lost data arising from use of the app. Our aggregate liability relating to the app is limited to the fees paid for the app during the twelve months before the event giving rise to the claim. Nothing in these terms limits liability that cannot legally be limited.

12. Suspension and termination

A merchant may stop using the app by uninstalling it from Shopify. We may suspend or end access where the app is used in breach of these terms, where required by Shopify or law, or where continued operation creates a material security risk.

13. Changes to these terms

We may update these terms as the app develops or legal requirements change. The current version will remain available at this URL with its latest update date.

14. Governing law

These terms are governed by the laws of the Republic of Kazakhstan, without removing any mandatory rights or protections that apply to a merchant under the law of another jurisdiction.
